The Lviv City Council was defeated in all courts of law in the case of registering a petition for the resignation of Andriy Sadovyi.
The courts – from the district court to the Supreme Court – clearly sided with the applicant and ordered the mayor’s office to publish the petition and open it for voting.
Despite this, the decision has not been enforced for a long time. Moreover, the city council tried to challenge the wording of the court decision through the “clarification” procedure, but was denied.
The Supreme Court’s ruling states that the position of the city council is effectively an attempt to change the content of an already adopted decision, which is unacceptable.
After that, the officials filed another complaint against the refusal to explain, but it was also left without action.
At this stage, the executive service joined the process to ensure the enforcement of the court decision.
In a public statement, lawyer Andriy Petryshyn said that the situation indicates an attempt to delay the process by the city authorities.
He also stressed that if the petition is implemented, the political consequences for Andriy Sadovyi could be significant.
The NGO “Audit Lviv” called on the mayor to take personal control over the execution of the court decision and ensure that the petition is registered in accordance with the law.
